Judge Refuse To Reverse ruling on R. Kelly sex videotape
The Cook County judge who previously past a ruling that will allow the media and the public to view a videotape at R&B singer R. Kelly's upcoming trial that allegedly shows the singer having sex with a minor, refused to reverse his ruling.
Kelly is charged with child pornography for allegedly making a video showing himself having sex with the girl when she was about 14 years old.
R. Eugene Pincham, one of the singer's lawyers, had asked Judge Vincent Gaughan to reverse his June 8 ruling allowing the public in the courtroom to view the tape. Pincham argued that the Illinois Juvenile Court Act bars the tape from being shown in open court. He said the alleged victim on the tape is now nearly 22 years old, but the Juvenile Court law would still apply.
Assistant State's Atty. Shauna Boliker said that even though the prosecution does not plan to call the girl as a witness, it believes she would be negatively affected by the court viewing the tape.
